PRIVACY AND PROCESSING OF PERSONAL DATA POLICY FOR 3D-BAZA.COM WEBSITE USERS

This Privacy and Personal Data Processing Policy (hereinafter — the Policy) applies to all information about the User that 3DBaza Market (hereinafter — the Company) may obtain while using the Website on 3d-baza.com's domain names.

PRIVACY POLICY PRINCIPLES  

The Policy is based on the following data protection principles:

Personal data shall be processed in a lawful, fair and transparent manner;

Personal data shall only be collected for strictly defined, unambiguous and legal purposes and must not be additionally processed in a manner incompatible with those purposes; 

The collection of personal data shall be carried out correctly and must be limited solely to the relevant information necessary for the purpose for which the processing of such data is intended; 

Personal data shall be accurate and updated as necessary;  

Any reasonable measures shall be taken in place to ensure that personal data revealing inaccuracies that are essential to processing purposes is deleted or revised instantly;

Personal data shall be stored in such a way as to enable a person to be identified only for the period necessary to achieve the purpose of data processing;

All personal data shall not be disclosed and stored in such a way as to ensure its proper security;

Personal data is not transferable to third parties, unless such transfer is necessary for 3DBaza Limited to be able to provide the services provided by the Agreement;

DEFINITION OF TERMS

1.1. The following terms are used in this Policy:

1.1.1. “Website Administration” are employees authorized to manage the Website, acting on behalf of the Company, organizing and (or) processing personal data, as well as determining the purposes for which personal data is processed, the composition of personal data to be processed, the actions (operations) performed with personal data.

1.1.2. “Personal data” is any information related to an identified or identifiable individual. Personal data includes all types of information that directly or indirectly identify a person: name, date of birth, address, email, phone number, etc.

1.1.3. “Personal data processing” is any action (operation) or set of actions (operations) carried out with or without the use of automation tools with personal data, including the collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of personal data.

1.1.4. “Confidentiality of personal data” is a binding requirement for the Operator or any other person who has access to personal data that it is not permitted to be distributed without the consent of the data subject or other legal grounds.

1.1.5. “Website User” (hereinafter — the User) is a person having access to the Website via the Internet and using the Website.

1.1.6. “Cookies” is a small piece of data sent by a web server and stored on the user's computer that the web client or web browser sends to the web server whenever it attempts to open a page on a corresponding Website.

1.1.7. “IP address” is a unique network node address built over the IP protocol in a computer network.

GENERAL PROVISIONS

2.1. User's use of the Website means agreement with the terms of this Policy and the terms of processing of User's personal data.

2.2. The User shall stop using the Website in the event of any disagreement with the Policy terms.

2.3. This Policy applies only to 3d-baza.com Websites. The Company does not control or take responsibility for any third-party Websites that may be followed by the User through the links on the Website.

2.4. The Website administration does not verify the accuracy of personal data submitted by the Website User. 

2.5. By agreeing to this Policy, you acknowledge that you have sufficient knowledge of English to understand the terms set forth herein.

SUBJECT MATTER OF PRIVACY POLICY

3.1. This Policy sets out the Website Administration's obligations on the non-disclosure and protection of the personal data privacy that the User provides at the Website Administration's request when registering on the Website or when submitting a callback request, or seeks consultation on the Website.

3.2. The User provides personal data that may be processed under this Policy by filling out the registration form on the Website.

3.3. The Company protects the data that is transmitted automatically when viewing advertising blocks and when visiting the pages where the statistical script of the system is installed. Such data includes:

• IP address;

• cookies information;

• browser information (or another program that provides access to display ads);

• access time;

• page address where the ad block is located;

• referrer (previous page address).

3.3.1. We obtain certain data automatically through the use of cookies and tracking instruments such as the Internet Protocol (IP) address; browser type; Internet Service Provider (ISP); pages from which the customer enters the Website and leaves the Website; files viewed on our Website (e.g. HTML pages, pictures); operating system; date and time stamp; and/or click statistics to analyse current trends and to manage the Website. 

You can control the use of cookies at your browser level, but if you choose to disable cookies, this may limit the availability of some of our Website or service's features and functions.

3.3.2. The company collects statistics on its visitors' IP addresses, which are used to identify and resolve technical issues, to control the legality of financial payments made.

3.4.  Any other personal information not mentioned above (history of purchase, browsers and operating systems used, etc.) is subject to safe storage and non-disclosure, except as provided in para. 5.2 and 5.3 of this Privacy Policy.

PURPOSES FOR WHICH THE USER'S PERSONAL INFORMATION IS COLLECTED

The User’s personal data may be used by the Website Administration to:

4.1. Improve the Website and user experience. We collect this information using tools from third parties, such as Google Analytics or similar, to enable us to record and analyse Website usage statistics.

4.2. Provide services in accordance with the User Agreement, we collect personal data as required to provide and perform the services you requested.

4.3. Provide services between the parties to the User Agreement:

- payment card data is stored and transmitted in accordance with the basic standards of confidentiality and security of credit and debit cards in accordance with PCI DSS (Payment Card Data Security Standard).

- Payment card data is not requested and not used for any purposes not related to the payment of goods and services.

- Payment card data is not stored on the server.

- 3DBaza agrees not to disclose to anyone in any way the personal data of the client or information about the payment card and transaction - with the exception of the acquiring bank and Visa / Mastercard payment systems or at the request of public authorities.

4.5. Establish feedback with the User, including sending notices, requests for use of the Website, service rendering, processing of User requests and queries.

4.6. Identify the User registered on the Website for the purposes of filing a callback request or an email request.

4.7. Provide the User with access to the personalized resources of the Website.

4.8. Determine the User's location for security and fraud prevention purposes.

METHODS AND TERMS OF PERSONAL INFORMATION PROCESSING

5.1. User personal data is processed in any legal manner without limitation of the term, including in personal data information systems using automation tools or without the use of such tools.

5.2. The User agrees that the Website Administration is entitled to transfer personal data to third parties, trusted service providers when, on our behalf and in accordance with our instructions, they provide you with services. Under the following circumstances, we only share personal data with third parties:

if you have given your consent in accordance with para. 2.1;

if the purpose of this data transfer relates directly to the purpose for which personal data was collected initially;

where necessary to prepare, clarify and execute an Agreement with you;

if required by law, administrative or court order;

if required to substantiate or defend a claim or to defend a lawsuit;

if required to meet a legitimate request from public authorities, including national security and law enforcement agencies;

if required to prevent abuse or other improper acts, such as coordinated attacks, in order to safeguard data.

Service providers receive only the personal data they need to provide their services. We do not disclose personal data to third parties so that they can advertise their products or services to you.

5.3. User personal data may be shared with government authorities if we are required to disclose your personal data in accordance with the law or to comply with the authorities' legal requirements. Our partners which provide us with payment tools may have transaction data available.

5.4. The Website Administration shall inform the User of the loss or disclosure of personal data in the event of such loss or disclosure.

5.5. The Website Administration shall take the necessary organizational and technical measures to protect User Personal Information from unauthorized or accidental access, destruction, modification, blocking, copying, dissemination, as well as other third-party illegal actions.

5.6. Together with the User, the Website Administration takes the necessary organizational and technical measures to prevent losses or other negative consequences resulting from the loss or disclosure of User personal data.

OBLIGATIONS OF THE PARTIES

6.1. The User undertakes to:

6.1.1. Provide information on personal data required to use the Website.

6.1.2. Update, supplement the information provided on personal data in the event of a change in that information.

6.2. The Website Administration undertakes to:

6.2.1. Use the information obtained solely for the purposes specified in para. 4 hereof.

6.2.2. Keep confidential information secret, not disclose it without the User's prior written permission, and not sell, exchange, publish, or otherwise share User personal data transferred, except in the cases set out in para. 5.2 and 5.3 hereof.

6.2.3. Take precautions to protect the confidentiality of User Personal Data in accordance with the procedures commonly used in existing business transactions to protect this type of information.

6.2.4. Block personal data pertaining to the relevant User from the moment that the User or his/her legal representative or authorized authority protection of the rights of subjects of personal data has filed an appropriate request or claim for the verification period where unreliable personal data or misconduct has been revealed.

LIABILITY OF THE PARTIES

7.1. The Website Administration is responsible for complying with the requirements of confidentiality of personal data and the principles set forth in this Policy, except as provided for in para. 5.2, 5.3 and 7.2 of this Policy. The Website Administration takes precautions against possible violations in its Websites and customer databases; not a single Website or Internet transmission is completely safe. The Website Administration cannot therefore guarantee that there will never be unauthorized access, hacking, data loss or other violations. You use the Websites and Website Services at your own risk. The Website Administration strongly recommends that you take steps to protect the security of your personal information by remembering your password or saving it in a safe place (separate from account information), logging out of your user account and closing your web browser whenever you finish a playback session or leave your computer in a public place.

Unless otherwise stated, credit card numbers are used only for processing payments and are not stored for marketing purposes to protect the transmission of critical account information such as credit card transfers through the Services.

7.2. The Website Administration keeps records of the data processing activities under our responsibility and, if necessary, will provide these records upon request to the supervisory authorities. If Confidential Information is lost or disclosed, the Website Administration is not liable if this confidential information is as follows:

7.2.1. Before it was lost or disclosed, it went into a public domain.

7.2.2. Before being received by the Website Administration, it was received from a third party. 

7.2.3. It was disclosed with the User's consent.

MARKETING MAILOUTS

8.1 We can send you marketing emails with your consent. You must voluntarily, consciously and unequivocally give the consent referred to herein. If you give your consent to receive marketing letters (you give your active consent), these requirements will be deemed to have been complied with.

8.2 Upon prior request and free of charge, you can always object to the use of your personal data for direct marketing purposes without having to give the reason for such objection. By writing us at contact@3d-baza.com you can do this. If you object, your personal data will no longer be used for direct marketing purposes.

8.3 Marketing emails contain information we think may be of interest to you, such as information on our products and services.

SAFETY OF MINORS

The Website is not intended for users of minor age, although it does not contain any information that might harm them.  

9.1 You cannot create accounts on the Website if you are under 13 years of age. To sell at https://3dbaza.com, you must be of legal age in the country where you live to sign a binding contract. In most countries, this age is 18. If you are under 18, you can use an adult account with the account holder's permission. The account holder, however, will be responsible for all that this account does.

9.2. Information for parents. Parents shall regularly monitor how their child uses email and other online communications and transactional functions. Management tools are available from online services and software vendors that can help provide a safe online environment for children.

If your son or daughter used your credit card in our Services without your permission, immediately contact the support service https://3d-baza.com and we will delete their information.

9.3. Youth aged 13 to 18 years. If you are between 13 and 18 years of age, please ask your parents or guardians to read this Policy and give his/her permission before you give us any of your personal information.

DISPUTES SETTLEMENT

10.1. Before filing a lawsuit in court for disputes arising from the relationship between the Website User and the Website Administration, a lawsuit (a written proposal for a voluntary settlement of the dispute) must be lodged.

10.2. The claimee shall notify the claimant in writing of the results of the consideration of the claim within 30 calendar days from the date of receipt of the claim.

10.3. The dispute will be referred to a judicial body if the agreement is not reached.

ADDITIONAL TERMS AND CONDITIONS

11.1. This Policy can be modified by the Website Administration without the User's consent. If we make any changes to this Policy, you will be informed of the latest version of this Policy on our Website at https://3d-baza.com/article/Privacy_Policy

11.2. The new Policy comes into effect upon being posted on the Website, unless the new version of the Privacy Policy provides otherwise.
